Pre-construction condo/Sq. Ft. Discrepency/Deposit Refund

I am under contract to purchase a pre-construction condo. I am attempting to get my deposit back. The original survey recorded in the condo docs states the sq. footage is 80 sq. ft. more than it actually is. Is an 80 sq. ft. discrepency reason enough for the builder to have to refund the deposit?

If so, would I be required to do to document this (home inspector's measurements or new survey)?

If the builder is required to refund the deposit, do they have a time requirement in doing so?
