Pre-construction Deposit refund

I have entered into a pre-construction condo and the contract states that the seller will complete construction no later than two years from the date of the agreement. Then there is a clause for extensions for ''acts of God'', ''unavailability of materials'', and ''labor problems''. It has been about 3 months over the 2-year contract. The seller states there is enough verbage to go beyond the 2 years. How long can they keep using this excuse? I would like to get the deposit back.

In reviewing your question , it seems that the seller is pushing hard. It is imperative that I review the legal documents at the time you signed them. In order to evaluate the proper position for you take I would need to review your contract and any associated documents to better ascertain your legal rights. I would suggest you scan the documents and e-mail them to me or fax them to me so that I could review them and discuss your legal rights.
