Preferred Builder Program
I purchased a lot in a golf course community with a preferred builder program. I must choose one of the preferred builders to construct my home. There are ten builders in the program of which only three have experience in the price range and square footage of home I want to build. Only two have extensive experience (more than three homes) in my price range.
The development is essentially forcing me to pay substantially more money for my home by limiting my choice to two contractors. As the owner of the property, do I have any legal basis for a challenge to this program? I would like to hire an outside builder and would agree to pay the development its builder's fee (''kickback'') required of every preferred builder.

Without seeing the contract which seems to bind you to a preferred builder, I cannot give you a meaningful reply. Why not discuss the matter with the developer? Or, consult with competent counsel in your vicinity.
