Legal Question in Real Estate Law in Florida

Previous Tenant wants to sue

A previous tenant wants to sue us, claiming discrimination. He said the house, which is located in a rural area in Florida and on a river had mold and mosquitos and the house was on blocks where cold wind blew underneath. He ''chose'' to live there for at least 15 months, was never forced to remain and was never evicted. Can he now claim damages or discrimination when he always had the ability to move somewhere else? Is there a monetrary limit on claims in such a case? Would a judge ever see a case such as this ?

Re: Previous Tenant wants to sue

How is it discrimination? Last time I checked, mold and mosquitos attacked people of all races religions, nationalities, etc. Also, last time I checked, we didn't have many cold winds in Florida.

Like you said, you didn't force them to stay. You didn't lock them in the house for 15 months. Their lawsuit sounds ridiculous but, unfortunately, landlords must sometimes put up with this nonsense. Still, all lawsuits must be treated seriously, and you should speak with a Florida lawyer about how to have the lawsuit dismissed and how to recoup attorneys' fees for your troubles.
