Legal Question in Real Estate Law in Florida

I'm in the process of modifying my mortgage and the bank had started the foreclosure process but it has been stopped because I retained a lawyer. I've been current with my HOA and have not had any money in arrears or been late in making my assessment payments. The HOA is charging me $250 for attorney fees they incurred because the bank sent them a letter about their intention and the public record shows my house in Lis Pendins. My question is, why did they have to charge me this fee if I'm not in arrears and the property is not foreclosed or will be any time soon?

This $250.00 fee that the HOA is attempting to charge does not appear to be legitimate. The attorney representing you in the foreclosure case can assist you with dealing with this.
