Legal Question in Real Estate Law in Florida
Property Damage
As a result of last year's hurricane, several trees are leaning toward my property, and some have fallen in my yard very close to my house. The land/house are vacant, however, I sent a certified letter to the owner asking him to remedy this problem. We received the signed ''receipt'' back in the mail but have heard nothing from him. Today a tree fell onto my shed, ripping a hole in the side of it and crushing the roof. Is he responsible for the damage/repair on my shed? Also, a large dead tree is leaning toward my house...it is sure to hit my sunroom WHEN it falls. I have no idea where this individual lives, so I am only able to contact him by mail.

Re: Property Damage
Since you put him on notice of the dangerous conditon, he is responsible.
Re: Property Damage
He should be responsible, though there are many ways of remedying the situation.
