Legal Question in Real Estate Law in Florida
Can I take property like inside doors from my home that I have a mortagage on and my ex wife abonded?
1 Answer from Attorneys
A door is part of the real estate, as is everything that is screwed or nailed to the property. Other items that are integral, light fixtures, plumbing, HVAC equipment, landscaping, etc are all real estate. If only your ex wife owns the property, you are stealing from her. If you AND your Ex are both on the mortgage, you both owe the money, regardless of who is on the title. If the lender forecloses, and sells the property at a loss, you and your Ex will both be liable for the deficiency. Obviously, the property will be worth less and less, as you strip valuables and cause deterioration, meaning that you will eventually owe the lender much more than the value of a used door. Unless you are ready to declare bankruptcy, you still have something to lose financially. You need a real estate attorney to prevent you from shooting yourself in the foot.
