property lease agreement

My mother is in a nursing home and will be going under medicaid shortly. We want to preserve the home for as many years as necessary. I have someone who is willing to live in the home just to pay utilities, and that is fine with me. I don't believe I can rent the home as that would be rental income subject to medicaid income rules. If a person lives in the home on a month-to-mnoth basis only paying the utilities used, do I need a rental agreement or lease agreement.

The lease must be in writing to protect your interests.
