Legal Question in Real Estate Law in Florida
Real Estate Commission
I am the Listing Agent for a property that sold. The Buyer, who lives in New Jersey, arrived at the closing and informed us that she changed her mind and was not going to purchase the property. My Sellers do not wish to pursue legal action on their end, but are so upset with the failure of the sale to go through that they have relisted with another Real Estate Firm, even though there was nothing I could have done to salvage this deal. My questions are:
1) Can I collect my commission from the buyer who violated the contract to purchase?
2) If so, can this be done through Federal Court or would I have to go to New Jersey to file?
3) What is the likelihood of recovering my legal fees?
