Real estate gift with judgement on personal property
A friend of mine was in the process of selling his property when the title company found out his ex wife has a judgment against him. The house has florida homestead exemption and we were told she could not go after the house for the money she claims he owes her. What we would like to know is if he ''gave'' me the the house as a gift, and put everything in my name, would the house itself carry a lien, or will he be clear of this? Also, what would I have to claim as income or taxes relating to this gift?... Thank You, Star

A transfer made without consideration for the purpose of avoiding potential creditors is deemed fraudulent and void. Don't waste your time.
