If you own real estate with another person, and you wish to sell it but the other person does not, you file a court action to order it sold (action seeking sale in lieu of partition). The Court then orders the property to be sold, and the proceeds divided.

There are a few limits on who is entitled to this kind of court order, but generally, if you are the owner of half of a house you can not be forced to stay half owner, you can have the Court order that the house be sold.

This is not a terribly hard lawsuit to win, provided you meet the legal requirements.
