Real Estate Scam

Three years ago, when we lived in another state, we decided to buy a lot in Charlotte county being advertised on EBay. We corresponded with the seller via email and telephone. We sent a down payment and were to pay it off in 3 years.After making 2 years worth of payments, the seller contacts us to tell us someone else had contacted him in regard to buying our lot and would we like to sell it at this point. We said no, in fact we would like to pay off the loan now and get the warranty deed. From that point on we never heard from him again, could not locate him, and our certified letters to his mailing address came back to us. After alot of searching, I think I have located him in St. Petersburg FL. Also discovered that he had sold out lot to someone from New York.This guy has $6500 of our money.We have since moved to FL and live in Lee County. In the process of moving, we now cannot find our copy of the contract. We want to sue this guy now that we have located him. We spoke with one attorney but he said his fee would probably run close to the amount of money we are suing for, and suggested small claims court. The seller lives in Pinellas Co, we live in Lee Co, and the property is in Charlotte Co. Which county do we file in?
