my wife has passed away the home mortgage is under her name there is still a balance owed, will i have to refiance? i can afford to make payments on home balance of about 75k but would like to keep the same rate we have. the home is going to be quitclaim deed to me

You will likely have to refinance in order to get the mortgage in your name. I would suggest you talk to the lender and try to work it out, and stand firm on negotiating a good rate. You may actually get a better rate than the one you currently have.

If you do not want to refinance, just keep paying the mortgage. The lender will not look into it as long as they are paid.
