Legal Question in Real Estate Law in Florida
Realestate law / Landlord dies / Probate
I have been a tenant for 7 years, I pay rent monthly, my landlord comitted suicide 4 months ago and my landlord's estate is in probate. The sister now wants to live in our apartment and prepairing to evict me and my wife. The landlord and I had numerous verbal agreements, no lease was ever prepaired. Does the sister have the power during probate to independantly evict tenant's in good standing without a court's order, a retalitory eviction for her own gain to take over her dead sister's home.

Only the court appointed personal representative of the estate can do that.
