Legal Question in Real Estate Law in Florida

Reclaiming a business

We sold a restaurant and sublease in April. Purchaser has been late each month in paying - this month, no payment at all. What is incurred if we initiate proceedings to take back the business and evict them?

Re: Reclaiming a business

In terms of attorney's fees, it depends on many factors, including the complexity of the issues involved in the dispute, the value of the lease or sublease and how much the future defendant is willing to spend to defend itself. I have handled litigation matters involving landlord-tenant disputes over a commercial lease that get resolved for as little as $1500-$2500 and I have handled others that have taken well over $100,000 in fees to get to trial. There's no cookie cutter recipe for these matters. You will need to consult with the attorney you intend to hire, and provide additional facts, to get a better idea of the expenses involved in your particular matter.

Without kowing all the facts involved I cannot tell you what your legal and court costs will be. An initial consultation at your offices would be $100. Once I reviewed the lease and contract I would be in a better position to discuss this. Good Luck.
