Rental property if occupied by son?

I currently own two properties. One of which I have owned for over 30 years now of which I moved out of approximately 17 years ago. This property was incorporated into the city in the past few years where it was previously part of the county. My son currently occupies the house and the city is trying to claim this constitutes a rental property. As a result they are trying to charge us a yearly fee and require yearly inspections of the property. He does not pay rent, but pays all the bills for the house including the taxes. Does this constitute a rental property? Nowhere in their statutes can we find what constitutes a rental property or what definition they are using.

Since he is not paying you , there is no rent.
