Legal Question in Real Estate Law in Florida

Renting Room-mate's

I have been paying my rent on time for 8mths. My room-mate who is on the lease has been paying their rent late every month. In July, We received a 3-day eviction notice because unknown to me, my room-mate owed all these late fees and hadn't paid all of their share of the rent. The Landlord is pressuring me to make sure all the rent is paid together on time.

Is it my responsibility to chase the room-mate for their half of the rent when their name is on the lease also?? If he kicks us out will I lose my deposit also?? I do not know what my rights are.

Re: Renting Room-mate's

If you and your roommate are both named as tenants under the lease, then it is likely that you are jointly and severally liabile under the lease. That means that if your roommate defaults, it will inevitably (and unfavorably)effect you. You need to get your rommate to comply with the lease or you need a new roommate. Your roommate should pay for the late charges, but if he doesn't, you will likely have equal responsibility to the landlord for those unpaid charges. Seek the advice of counsel and good luck.
