Legal Question in Real Estate Law in Florida

I believe the required factual elements necessary to impose a lien pursuant to � 196.011(9)(a) are as follows:

(1) the use of the property changes so as to change the exempt status of the property OR

(2) the status or condition of the owner changes so as to change the exempt status of the property, AND

(3) if the property owner fails to notify the property appraiser that the use of the property changes so as to change the exempt status of the property, or the status or condition of the owner changes so as to change the exempt status of the property, AND

(4) the owner was not entitled to receive such exemption.

If these are the required elements to impose a lien is there a better way to write it or have I misunderstood the required elements.

Huh? The statute is long and complicated. What are you writing it for? The bottom line is that you cannot claim an exemption or continue to use one if the status for it is lost. If you do then the property appraiser can impose a lien as specified by the Statute.
