Rerenting while under lease

Our lease is up at the end of Oct. Our landlord has rerented the house and wants us out by the 21st of Oct. because the new renter needs to move in early. Is this legal?

No, but use it to your advantage. If you are able to move out by October 21st, advise the landlord that you will gladly accommodate him/her if they waive rental for October and guaranty in writing that the entire security deposit shall be returned unconditionally. However, if you want to stick to your guns, you can require the landlord to let you stay the 10 days he is trying to take from you. In short, if you stay on the premises until the end of the lease term, the landlord would not have much recourse against you, but he/she may try to make a claim on the security deposit. Good luck.
