Legal Question in Real Estate Law in Florida

Several residents in my community in Davenport FL...Preston woods by Lennar at Providence (ABD Development), purchased lots based on the fact we were told by two different builder Agents we could instal privacy fences due to the proximity of a city ownen water reclamation plant. The Association is refusing to approve design plans that include privacy fence of any kind. What recourse do we have if any?

You can sue. Whether or not you will collect will depend on if you can PROVE intentional or negligent misrepresentation by the builder's agents, your reasonable reliance on the misrepresentation, and damages arising from the misrepresentation. You will need a real estate attorney.
