How do I get my rightful share of property after breakup

I split with my boyfriend after five years of owning a home on Cape Cod Massachusetts. I moved to Florida, he refinanced the house and I was informed in order to get part of my share I needed to sign a quit claim deed. (I got approx. $20,000.00 so I did not get my full share. We purchased the home in October of 1999 at $142,000 and at the time of my departure it was worth close to $400,000.00.) Unfortunately I did. I imagine I have no recourse in this situation. To make matters worse I did another stupid thing when we got back together (briefly) and I put up $5000.00 for a downpayment on two lots in Florida and am on the deed, but so is his dad because he needed a cosigner. His dad did not invest any money and the property is all paid for now. The original price of the land was $18,500.00 and is now worth approximately $100,000.00. How do I break free and get my fair share of the land, I know he'll put up a fight over this.

As an owner you bring a partition action to sell the Florida property. A court will determine your share.

You may have recourse as to both property. Certainly partition or its equivalent in Florida, and an equitable action in Massachusetts.
