Legal Question in Real Estate Law in Florida

Roomate Did Not Pay Rent

My Fiancee's roomate did not pay his half of the rent after reassuring my fiancee that the rent would be taken care of for the months of May and June. In addition, when the initial eviction noticed was served, his roomate kept it from him until 11:00 a.m. on the day before they were to be out of the apartment. My fiancee has receipts for his half of the rent for May and June. My question is this, is my fiancee responsible for the charges from the apartment complex. They include legal fees, cleaning charges, trash removal and the rent that was not paid by his roommate.

Thank you

Re: Roomate Did Not Pay Rent

If you fiancee signed the lease together with the roomate, it is likely that your fiancee is liable for all damages being claimed by the landlord. Of course, there may be defenses depending on the facts and the terms of the lease (which I have not read), and your fiancee may have a claim against his roomate. Without learning more facts and reviewing the lease, I cannot provide you with more guidance. Good luck.
