Legal Question in Real Estate Law in Florida

Sale of home

I am buying a house w/ someone, we are not married. We agree in the event of a break up the house has to be sold and the profit split 50/50. What form could I use or do I have to go to an attorney and have something drawn up? Thank you

Re: Sale of home

There is no such form. An agreement must be signed by both of you.

Re: Sale of home

I am not aware of any cookie cutter form that will address the issues relating to your situation. I have been involved in these types of situations before, both at the outset and when the couple breaks up and disputes arise. You need to have an attorney prepare an agreement to protect both of you and provide a roadmap of predictability in case your relationship goes south. I encourage both of you to spend some money on an attorney now because it may very well save each of you an enormous legal bill down the road.
