Legal Question in Real Estate Law in Florida
Sale of a Property Joinly Held
I would like to refinance my home that my ex-wife and I jointly own. I dispute my ex-wife's real interest in the property and wish to seek legal advice on my rights. What type of attorney should I contact? I wish to avoid a lawsuit but arbitration may be an option.

If the divorce decree is silent regarding the property litigation may be necessary. Arbitration requires both parties to agree to it in writing. Good luck.

You should contact a lawyer experienced in both transactional and litigation matters involving real estate. Good luck.

Typically property rights are addressed in the divorce. If not, marital property under most circumstance becomes a tenancy in common upon divorce with each party having an undivided interest in the property. Please feel free to contact me if you wish to discuss the matter in greater detail.
