Legal Question in Real Estate Law in Florida

We own a seasonal home in Kentucky, and for the past 6 months we have tried to have the banks that own the property next to ours remove a very large galvanized steel antenna (about 30 to 40 feet tall) that was threatening to fall on our home. First Countrywide assured us that it would be taken care of immediately, then Bank of America, and then Hud who is now the official owner of the property. Now the antenna has fallen on our home, and from the picture our neighbor sent, it looks like it may have damaged the roof. One more big wind will no doubt result in major damage. My husband and I are both under doctors orders to avoid any and all stress and we do not need this aggravation. We have already had to make one trip up there to try and resolve the matter, costing us not only the expenses of the trip, but also lost wages, and now it looks like we will have to go again to assess any damages, especially to the inside of the house if there was a roof leek. This is a very bad time for us to have to do this as there were 11 layoffs at my husbands job recently and taking time off from work may just cost him his job. I am not able to make the trip alone, so that is not an option. This whole incident could have been prevented if they had removed the antenna 6 months ago when it came loose from their property and I notified them of the situation. Any advice that you could give would be most appreciated. Thank you and have a lovely day.

Kind Regards,

Susan Meade
