Legal Question in Real Estate Law in Florida

Section 8 evictions

I have a tenant that is on the Housing Authority section 8 program. She is required to pay a portion of the rent. She is behind. Are there any special proceedures involved in evicting a sec 8 tenant? I was told to by a friend to just send a copy of the 3-day notice to the housing office. All else is the same? My lawyer could not find out any answers. Please help!

Re: Sect. 8 Evictions

FACTS: Tenant on Housing Authority Section 8 program; Required to pay portion of the rent; behind.

Q. Are there special proceedures involved in evicting Sect. 8 tenant?

A. Yes. It is difficult to evict a Sect. 8 tenant. The procedures are cumbersome and involve considerable delay. You do have to notify the Housing Authority and give the proper notice. Your Atty. can check with the Fla. Bar. They have Books that explain the proper procedure Attys. must follow.
