Legal Question in Real Estate Law in Florida

How do I get my security deposit back?

I moved from Broward county to Lee county recently. Most of my security deposit from my last lease is being held. The reason I was given was that I had not given enough notice. I did. Upon pointing this out, a new reason was given - that I had not paid rent for the last few days of my lease agreement. I have the cancelled checks that prove that I paid everything owed. I'm tired of fighting them. I would like to know where and how to file to get my money back. I feel comfortable handling this myself, but I do not know where to start. May I file in any county?

Suit for security deposit

Q. I would like to know where and how to file to get my money back. May I file in any county?

A. If your deposit was under $5000.00, then you file your suit in the County Court where you leased your unit (where the property is located.) You may also sue in the county where the defendant resides or has its principal office.

The clerk of the court will help you with the suit papers if your claim is under $5,000.
