Legal Question in Real Estate Law in Florida

I am seeking a law firm that can advise me on a condominium laws and real estate issue. I own a condo in Bay Harbor Island, FL and it has an assigned dock space in the title. The condo association is renovating the building and wants to remove the complete dock because of the cost involved in bringing it up to code as required by the City and DERM. They are telling the condo owners that own an assigned dock space to pay for the renovation of the dock or it will be removed completely. They are also trying to charge the renovation of the docks exclusively to the unit owners that have an assigned dock space. Can the condo association legally abolish and remove the dock from property? Can the association charge only a few condo owners for the dock renovation beeing that the docks are a common area and an assigned space? Can you represent us the owners of the condos with assigned dock space?

You should review the deed to your condo and your condo association's governing documents (e.g. the by-laws). An attorney can review these documents for you and discuss with you what your options are and your need for further representation, if any.
