Legal Question in Real Estate Law in Florida

Seller & RE Agent lied on disclosure

Seller and Real Estate agent both had knowledge of the a plumbing problem that could call for assessment and did not disclose it on the seller's disclosure statement. Also, they claimed on the disclosure that building's roof had been replaced by the association 5 months prior to the sale. In actuality the roof was repaired, however both the agent and seller sold me the unit stating REPLACEMENT on my contract. The Condo association approved the sale of my unit without ammending any of the information stated on the contract. Now the roof and the plumbing problems are up for assessment. What can I do.

Re: Seller & RE Agent lied on disclosure

Based on what you said, it appears you may be able

to sue the previous owner and his real estate agent

for misrepresentation and failure to disclose. I

suggest you consult an attorney who can advise you

of the pros and cons.
