When can Seller cancel an ''As is'' contract?
A Broker in my area wanted to purchase my home prior to auction but has had problems getting funding. She has put off the closing date several times and we are now in the third month of waiting for her to get her act together. She now claims to have the property turned into a HUD property but I want to cancel. Can I do so without penalty? Do I have to return her escrow deposit as well? I do not feel she is being forth right in her business practices & I do not trust her as she has not done anything she promised verbally and written via Email. I signed an as is contract but again I feel she is taking advantage of my situation. Can I cancel without penalty?

It depends on the terms of the contract.I would need to see a copy of the final contract to determine your rights. Call me at my office or e-mail me a copy of the contract as soon as possible
