Legal Question in Real Estate Law in Florida
Seller wants land back after missing payment
I have 1.5 acres of property in Bayou Geeorge, FL 32404.
I have made payments of around $12,000.The selling price was
$17500.00. I have missed a few payments and the owner wants my wife and I to sign a quit claim deed over to him. He says I have broken the contract. Fact is I have never seen nor signed a contract. The land also has exploded in value.
Also what are the laws governing the intrest payed. Does the seller have an requirment to send me a 1099 or whatever the form is telling me how much intrest i paid? I have never seen and intrest staement either. He says if I don't sign the quit claim he will take me to court. I have proof in payment of monies to him in returned checks. What are my legal rights? Thanks for any help. One more thing, my parents bought property from this same person and found out when they tried to claim there intrest paid on their income taxes, he told them not to, that he had to take care of something. So they have not been able to file yet for the last 6 years. I firgured I am in the same boat with him since i have never seen an intrest paid document.
Thanks again

Re: Seller wants land back after missing payment
You need legal representation. Do not sign anything. Contracts for the sale of land must be in writing.
