Legal Question in Real Estate Law in Florida

Show me the money (my $$$)

The apartment where I stayed for 2 years is claiming they are keeping $300.00 out of my $500.00 deposit. They are charging me $180.00 for touch-up paint, $60.00 for steam cleaning the carpet and another $60.00 for cleaning.I hired a maid upon my departure for $50.00.During my stay, they had to change the carpets due to a leak in my apartment wall that was still not fixed when I left. I know for a fact they had to paint anyway due to the water stains from that same leak. Other than those water stains I don't know what touch-ups they are referring to. I did call a Zoning Inspector on them for the bad leak that I had and I think they just may be bitter towards me. Any suggestions?

In order for a landlord to retain your security deposit, assuming you moved at the termination of your lease, he must send you letter certified mail, itemizing damages. There are certain time periods for him to do this andfor for you to object.

You can check Chapter 83, Florida Statutes for those details.

Rental Deposit Dispute

If you dispute the amount they are claiming, you must notify them of your dispute by certified mail within 15 days. Then you take the matter to court and the Judge decides what is the proper amount. Whoever prevails gets atty. fees and court costs.
