Legal Question in Real Estate Law in Florida

I sold a property for which I was not paid

This is being investigated by the criminal justice div for conspiracy to commit fraud - case is well known by two states also involved - buyer just put up the house for sale in Naples and I want to protect my unpaid equity of $173,125.00 - I re-filed my initial deed from when ''I'' bought the property from the developer. I don't know what to do or how to do it - please help.

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

Frankly, the filing of your old deed will have little effect on the title and will not stop the party from reselling it to a third party. You need to immediately retain a competent real estate attorney who can file a lis pendens followed by a suit. There are various types of actions that can be filed but sitting back and doing nothing while waiting and hoping for criminal charges to be filed will not resolve your problem.

It will cost you some money to hire an attorney but the attorney should be able to help you regain ownership of your property if the facts you presented are correct. In the long run you will be much better off.

This is much too complicated to answer here. Retain counsel who can review all the documents. Legal papers may have to be filed. Good luck.
