special assessment

This concerns a homeowners manufacture home park, (Co-op). The first of this year I was assessed $240.00 to pay attorney fees. I April 98 I was again assessed an additional $300.00 bringing the total to $540.00. I paid the $240.00. What would happen if I refuse to pay the additional $300.00? There is a good possibility of more assessments. I own a share in the Co-op.

What would happen if I refuse to pay?

The association would file a claim of lien against your ownership interest which would add interest, costs, fees, and could lead to foreclosure or loss of your ownership rights. If this occurred there would be court costs and attorney's fees for the co-ops' attorney. You will end up owing a lot more than the three hundred additional they are requesting. You need to read the copy of the basic documents that you got when you joined. They should tell you that if you dispute an assessment and do not pay, that they can file a claim and foreclose. Your co-op would be the exception if it did not include this language.
