Legal Question in Real Estate Law in Florida

Spouse's Rights

my husband & I are separated. He wants me to sign documentation giving him the 'ok' to acquire a mortgage for a florida property he is buying which was initially supposed to be OUR investment. I asked him about the deed and he clearly stated I would not be named on it. What are my rights and is it advisable to sign these documents? (We currently have a mortgage on a home we bought together- I am on the title/deed but the mortgage is under his name only) thank you

Re: Spouse's Rights

I would be careful and have any documentation reviewed by both a real estate and matrimonial attorney. Be sure the documentation does not allow the equity in the marital home to be used to support the new mortgage in Florida. The question of the mortgage on the marital home and what might happen to it should be handled by a NJ matrimonial lawyer. I need to see the documents before I can give you a better answer.

Do not sign anything. Go see an experienced divorce attorney and get some sensible legal advice. It is not possible to tell you what to do and how to do it over this computer system.
