Legal Question in Real Estate Law in Florida

How to start a foreclosers

I have a contract with a couple who has purchased property from me. I financed the property and they were to pay monthly. They have not keep thier part of the contract, by being months late on payment and not paying the taxes. I would like to know where I start to forclose on them and get them off my property. Should I just take them to small claims court, this is less then $3,000? I have sent certified letters which they have refused. I am willing to do the leg work but I don't know where to start. HELP!

Re: How to start a foreclosers

While you may obtain a money judgment against them in small claims court you cannot start a foreclosure there. Foreclosure is controlled by Florida Statutes 702 and 69.041. You can go to your local library or use the internet and look up foreclosure legal forms. Good luck.
