Legal Question in Real Estate Law in Florida
State lien on property for criminal restitution
Is it legal for the state of florida to place a lien on my property that has a homestead exemption. The lien is from a conviction where the main so called co-conspiritor was ordered to pay restitution. He went to jail and they gave me probation but said I had to pay his restitution. They then liened my property. My property is co owned with my wife and has homestead exemption on it.
Is there a way to get rid of the lien?

Re: State lien on property for criminal restitution
The lien does not attach to homestead property. You should retain counsel to make application to the court for an appropriate order.
