Legal Question in Real Estate Law in Florida

I have someone staying in a room behind my garage and I have been asking him to move since July. He refuses to leave because he says he can not find a place and does not have enough money. He stopped paying rent and the police say I need to evict him. I went to court today and they said I can not evict him because we never had a lease. He originally was staying temporarity until he found a permanent place. He has destroyed my property and made damaging alterations to the permanent structure. I filed a complaint for ejectment today and I want to know if he has any rights with an ejectment like he might have if he actually were considered a tenant?
