Legal Question in Real Estate Law in Florida
I suffered water damage from the condo above. I lost 5 months rent. Just as I was getting ready to file in small claims court, the owner transfered the property to her sister. The owner lives in New Jersey but the condo is in Florida. Who am I suing and can I garnish either sister's wages?

You should check with an attorney that specializes in condominium law. Under Florida Law, you may not be able to sustain an action against the neighbor upstairs anyhow. The exact situation happened to my own mother.

If you can prove negligence, the former owner would be responsible.
