Legal Question in Real Estate Law in Florida

If you are supposed close on a apartment on a certain day and the person who sold it to you didnt own the apt it was in propate but took a deposit how long after the closing date is the contract no good and do we have the right to get our deposit back which he refuses to release our money from escrow can we sue the apt owner and the reality that took our money thanks

It really depends on the contract. If drafted properly, it may not be void. Were there any contingencies in the contract?
