Legal Question in Real Estate Law in Florida

Survey

A lady that owns a piece a land next to my dad's land is selling her land and she surveyed a small piece out for a lady next to my dad's property. The survey said that her land went over on my dad's land by 50'. My dad is having his land surveyed to see if his deed is correct. The way it looks my dad's property is correct according to the map. The survey is not complete yet but the surveyor said it looked good. My question is the burden of proof should be on the other lady because her deed could be wrong so could my dad pull her survey markers up off his property and tell them they are tresspassing since my dad got a letter from her lawer stating that my dad was tresspassing on her property?

This answer is not intended to create an attorney/client relationship and any information provided is general information only. Please contact me directly for specific advice. Both surveyors will need to review their surveys, along with the deeds to determine where the property lines lie. Where the property lines are should be clear unless there is a problem with one of the deeds. They have an attorney and so should you; consult with one immediately!
