Legal Question in Real Estate Law in Florida
telemarketing companies
I have been trying to sell my time share, and when I got a call from this company I signed with them. I paid them $800.00, I've called them about 3 times during the first 6 months, but always got the answer that things were going well, but on sale yet. I now have called them 3 or 4 times and they have not gotten back to me .I looked them up on the internet and found them on RIP-OFF by two other people, having the same activity. Is there anything I can do ? I live in Texas they are in Florida. Contact was made by telephone.

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.
You may wish to file a complaint with the local Better Business Bureau or with the Attorney General's Office. If you do, I would mention the other complaints made by parties as you stated in your question.
Going to court would probably be a waste of time. If they are licensed real estate brokers (as they should be) then you can file a complaint with the Florida Real Estate Commission (FREC).

You could sue them in small claims court in Florida, but you may only end up with a worthless judgment aainst them. It just might be time to cut your losses and move on.
