Legal Question in Real Estate Law in Florida
I have a tenant who had a knee replacement and she asked her daughter to come stay with her temporarily after the surgery. The daughter has now begun receiving her mail at the residence and has stated she isn't leaving without a formal eviction. Can she do this? She doesn't pay rent. We never gave written permission for her to be there and our lease says no subletting.

your lease agreement controls. have an attorney review it with you so you can discuss your options. you really cannot evict the daughter, but you could evict the tenant if having 2 permanent residents is against the lease terms. Is this all causing a problem? Is it in a house or an apartment. Those are going to be factors to consider.
