Legal Question in Real Estate Law in Florida
Tenant rights in foreclosure situation
My niece just rented a house on April 1, 2009 and signed a 6 month lease. While she was out her neighbors spotted people in her yard taking pictures, they informed the neighbor that the bank has bought the house and that the tenants should call the landlord. My niece (Tenant) has been trying to call the Landlord and has not gotten a return call. She doesn't know if she will be evicted because the landlord has foreclosed on the rental property??What should she do & what are her rights under a signed 6 month lease agreement? To make things worse she is pregnant and was just getting settled in. She doesn't know whether to mail her next month's rent or hold off until knowing exactly where she stands? Please advise...she needs help!

She owes rent but I cannot tell to whom.
Re: Tenant rights in foreclosure situation
As the previous answer stated, she does owe rent, the question is to whom, and what her rights are. That depends on the status of the foreclosure. If it has been completed, and the property sold, she probably does not have a valid lease and could be evicted. At that point she would need to go after the landlord for her damages. If the foreclosure is just beginning, that is a different matter. My advice to you is to contact the clerk's office and try and determine the status of the foreclosure suit. That should give you some answers. After that, you probably need to speak with a local attorney to help her out.
