I have a rental property in FL that has been vacant for the past 3 months which made me get behind on the mortgage payments. I finally got the house rented last month & was hoping to start slowing catchin up on the mortgage. The first months rent was due on Oct 1st, 2008 along with the rest of the agreed upon security deposit. I finally received the rent less the security deposit yesterday (10/15/08). I contacted the tenant & told him they are breaching the contract by not following through with the terms of the lease & was basically told they do not care about the lease. From already being behind on the mortgage & now receiving this payment late, my property is on the verge of going into forclosure. I obviously do not want to be brought to court & sued by these ppl who are in the home now & I'm not sure what to do. If the home goes into forclosure with them in there within the next month or so, what can happen to me? What is my best & cheapest way out since I no longer have any funds available? My last tenats destroyed my home & I sunk all of my savings back into the home in hopes of getting it re rented to save it. PLEASE ADVISE.... Thank you.

You can seek their eviction or let the lender handle it in the foreclosure. As long as you own, they owe rent.
