Legal Question in Real Estate Law in Florida

Tenants Rights

1.) Does security deposit money (house rental) earn interest or is it legal for the landlord to hold it in an interest-free account?

2.) Is it legal for a landlord to ''show'' the house prior to the expiration of the lease because they do not want it to sit empty when you move?

Re: Tenants Rights

Florida statute authorizes the landlord

to deposit the money in a non-interest or

an interest bearing account. Although the

account should be separate and not comingle

with the landlord's other funds, I have not

seen any of the county judges in Hillsborough

County enforce this requirement. Yes, the owner

can show the house subject to the provisions

of the lease agreement any your right

to the implied covenant of quiet enjoyment.

To get a an opinion as to how these conce;t

might apply to your particular situation, I

suggest you make an appointment and consult

an attorney.
