Legal Question in Real Estate Law in Florida
Tenant/Tresspassors Disturbances to other tenants
I have recently moved into an apartment complex where I am living on the pool area. The pool are is open from 9am to 10pm. From day one I have not been able to sleep at night because of the other tenants and tresspassors in the pool. I have made several complaints to the office for a resolution. They refered me to call the after hours answering service where an on site police officer would handle the complaint. After many phone calls and more complaints to the management, I was told that I could not call the after hours line any more and I has referred to call the Jacksonville Police Department. The Jacksonville Police Department informed me that there was noting they can do other than ask the people in the pool to keep it quiet and refered me back to the management! In my lease it says that no disturbances or noise is tolerated and that the tenant will be asked to leave. Please help me... They are not willing to remedy this situation. Is there any thing that protects me in this situation?

You can seek to terminate your lease based on the landlords breach. You may call me after 8/6 for further information. Good luck.

You may be entitled to terminate the lease because of the landlord's breach, but one would have to read the lease and meet with you to learn all the facts before providing you with specific counsel concerning legal alternatives. Contact a local attorney in your county experienced in residential landlord-tenant disputes. Good luck.
