Legal Question in Real Estate Law in Florida

Timeshare Foreclosure question

If I buy a timeshare at the foreclosure sale (that is in mortgage foreclosure), and there was a claim of lien for the delinquent maintenance fees, am I responsible for those delinquent HOA fees, or not since this is a timeshare. THIS IS FOR THE STATE OF FLORIDA.

Re: Timeshare Foreclosure question

That depends. If the liens are superior to the mortgage that is being foreclosed then yes you do, if they are inferior, then no you don't. The only way to know the answer is to review the foreclosure file.

Good luck to you.
