Legal Question in Real Estate Law in Florida

Tranferring land to my brother

My sister-in-law lives in Florida and has 100 acres of land in georgia adjacent to ours. She wants to transfer the land in her brother's name, so her husband can't have claim on it. How can we proceed with this without it costing us an arm and a leg for this procedure? Does her husband have sign any papers? She wants out of the marriage, but does not want to sacrifice her kids inheritance (their not his kids). The land was divided between her and brother when Dad died. She tells me that the Florida law is that if you get a divorce everything is divided equally. Can you help us.

Re: Tranferring land to my brother

She certainly should speak with an attorney. The answer may depend upon whether her husband will consent. Her understanding of the law is not necessarily correct.

See an attorney in Georgia regarding transfer of the land. Her interest in the realty may not be subject to equitable distribution. Consult with Florida divorce counsel.
