Tree limb removal

I have a tree limb from my neighbors yard overhanging my pool. It is causing a lot of damage from sap and pine needles droping. I asked a tree service about cutting it down and they said there was a 75% chance cutting the limb would kill the pine tree. I talked to my neighbor and he said he did not want me to cut the limb down even though I offered to pay for the tree removal if it died. What liability do I have if I cut the limb down and the tree dies?
